Legal Use and Terms of Usage

Version 1.2.0 · Effective September 11, 2026

Agreement

These Legal Use and Terms of Usage ("Terms") govern your access to and use of the applications and AI-powered software services (collectively, the "Services") known as "FedXam," provided by RoadRun IT LLC ("RoadRun IT", "we", "us", or "our"). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you are using the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

1. The Services

RoadRun IT provides AI-powered educational software services, marketed under the product name "FedXam," that help users prepare for professional and licensing examinations through practice testing, progress tracking, analytics, retrieval, and AI-generated educational explanations. The Services may use machine learning models to generate output based on the input you provide ("Input") and the responses returned to you ("Output").

The Services are tools intended to assist you. They do not constitute legal, customs, financial, or professional advice, and RoadRun IT is not acting as your licensed customs broker, attorney, or advisor unless separately agreed in writing.

2. Platform / non-affiliation

This is an independent educational software platform and is not affiliated with, sponsored by, approved by, or endorsed by any U.S. government agency.

3. Government material

Certain questions, regulations, statutes, and other source materials displayed or referenced by the platform originate from publicly available government sources. The platform does not claim ownership of government works identified as such.

4. Subscription fee

Subscription fees are charged for access to the software platform and value-added services, including testing functionality, progress tracking, analytics, retrieval, and AI-generated educational explanations. Government source materials are not separately sold.

5. Exam integrity

Users may not upload, submit, reproduce, or request assistance with examination content obtained in violation of an examination nondisclosure agreement, security rule, confidentiality requirement, or other restriction.

6. Educational use

AI-generated explanations are educational aids and may not reflect the position of the administering agency. Users should consult the current official regulations, examination guidance, and agency publications.

7. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Services. You must provide accurate, complete information when creating an account and keep it up to date.

You are responsible for all activity that occurs under your account and for keeping your credentials confidential. Notify us immediately at contact@fedxam.com if you suspect unauthorized use of your account.

8. Acceptable Use

You agree not to:

Use the Services in violation of any applicable law or regulation, including export controls, sanctions, and trade laws.

Use the Services to develop a competing product, or reverse engineer, decompile, or attempt to extract the underlying models or source code.

Interfere with, disrupt, or place undue load on the Services or their infrastructure.

Attempt to gain unauthorized access to any account, system, or data.

Use the Services to generate or distribute unlawful, infringing, deceptive, or harmful content.

Misrepresent Output as professional advice or as having been independently verified when it has not.

Upload, submit, reproduce, or request assistance with examination content obtained in violation of an examination nondisclosure agreement, security rule, confidentiality requirement, or other restriction.

We may suspend or terminate access for any violation of these Terms.

9. Your Content

You retain ownership of your Input. You grant RoadRun IT a worldwide, non-exclusive license to use, host, process, and transmit your Input and Output solely as necessary to provide, maintain, secure, and improve the Services, and as otherwise permitted under our Privacy Policy.

You are responsible for your Input and for ensuring that you have the necessary rights to submit it and that it does not violate these Terms or any law. You must independently review any Output before relying on it. Consult the current official regulations, examination guidance, and agency publications rather than treating Output as the position of any administering agency.

10. Accuracy and AI Output

Artificial intelligence is probabilistic and may produce Output that is incomplete, inaccurate, outdated, or not suitable for your particular circumstances. Output may not reflect the most current laws, regulations, examination guidance, or agency publications.

The Services are educational aids, not a source of truth. You must not treat Output as authoritative or as reflecting the position of the administering agency. Verify Output against current official regulations, examination guidance, and agency publications before relying on it.

11. Fees and Subscriptions

Certain features of the Services require a paid subscription or the purchase of usage credits or tokens. Pricing, billing cycles, and included usage are described at the point of purchase. Subscription fees are charged for access to the software platform and value-added services, including testing functionality, progress tracking, analytics, retrieval, and AI-generated educational explanations. Government source materials are not separately sold. Unless stated otherwise:

Fees are billed in advance and are non-refundable except as required by law.

Subscriptions renew automatically until cancelled.

You may cancel at any time, effective at the end of the current billing period.

We may change pricing on a prospective basis with reasonable notice.

You are responsible for all applicable taxes. Failure to pay may result in suspension or termination of access.

12. Intellectual Property

The Services, including all software, models, designs, text, and trademarks (excluding your Input and government works identified as such), are owned by RoadRun IT or its licensors and are protected by intellectual property laws. The platform does not claim ownership of government works identified as such. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal educational purposes. All rights not expressly granted are reserved.

13. Third-Party Services

The Services may incorporate or link to third-party products and services. We are not responsible for third-party services, and your use of them may be subject to their own terms.

14. Confidentiality and Security

We implement reasonable technical and organizational measures designed to protect data processed through the Services, as described in our Privacy Policy. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

15. Disclaimers

THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROADRUN IT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE OR RELIABLE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROADRUN IT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ROADRUN IT FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

17. Indemnification

You agree to indemnify and hold harmless RoadRun IT and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your Input, your use of the Services, or your violation of these Terms or applicable law.

18. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services or other users. Upon termination, your right to use the Services ceases. Sections that by their nature should survive termination will survive.

19. Changes to the Services and Terms

We may modify the Services or these Terms from time to time. When we make material changes to these Terms, we will update the version and effective date and may require you to review and accept the updated Terms before continuing to use the Services. Your continued use after an update constitutes acceptance.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction in those courts, except where prohibited by applicable law.
